Effective Upon Tagging or Response
By responding #YesHorton or tagging Horton Painting Experts in a public post or comment, you agree to the following terms:
You hereby grant Horton Painting Experts, including its affiliates, contractors, successors, and authorized partners (collectively, “Horton”), a non-exclusive, worldwide, royalty-free, irrevocable, perpetual, transferrable license (with the right to sublicense through multiple tiers) to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform publicly, and display publicly your comments, images, videos, or other content posted on social media platforms (including but not limited to Facebook, Instagram, Pinterest, TikTok, or others) (collectively, “Social Media Platforms”) that:
• Tag @hortonpaintingexperts
• Use hashtags such as #HortonPainting, #YesHorton, or similar phrases that reference Horton in a clear and identifiable way
• Or are submitted in response to a request for permission using the hashtag #YesHorton
This license includes the right to use your content in any media or format now known or later developed, including but not limited to websites, mobile applications, online galleries, advertisements, printed marketing materials, press releases, or email campaigns.
You also grant Horton the limited right to use your name, likeness, username, or social media handle, solely as necessary to identify or attribute your content as part of the license described above.

Ownership and Representations
By giving us permission, you represent and warrant that:
1. You are the original creator or legal owner of the submitted content and have all necessary rights to grant this license to Horton.
2. The content does not infringe on any copyright, trademark, privacy, publicity, or other rights of any third party.
3. The content does not violate any applicable law, regulation, or the terms of any Social Media Platform.

Indemnity and Liability
You agree to release, discharge, defend, and hold harmless Horton Painting Experts, including its officers, employees, agents, and representatives, from any claims, liabilities, damages, or expenses (including legal fees) arising out of Horton’s use of your content as permitted under these terms.
Horton is under no obligation to use any content submitted or tagged, and may remove or stop using it at any time without notice.

Personal Data and Withdrawal of Consent
By granting this permission, you also consent to the use and processing of any personal information (such as your social media handle or image) included in your content by Horton, in accordance with our Privacy Policy.
You may withdraw your consent by sending a direct message to @hortonpaintingexperts on Instagram or Facebook, or emailing us at info@hortonpaintingexperts.com. However, please note that this withdrawal will not affect any use of your content already published or distributed.
Deleting the original social media post or comment does not revoke your license or agreement under these Social Media Terms of Use.

Governing Law
These terms are governed by and interpreted under the laws of the State of Texas, without regard to conflict of law principles. You agree to submit to the personal jurisdiction of the courts located in Fort Bend County, Texas for any disputes relating to these terms.
