3-Year Limited Workmanship Warranty

1. Warranty Overview
Horton Painting Experts (“Company,” “we,” “our,” or “us”) proudly stands behind the quality of our professional painting services. This 3-Year Limited Workmanship Warranty (“Warranty”) is provided to you, the original customer (“Customer” or “you”), for residential or commercial painting projects completed by our team, subject to the terms, conditions, and exclusions described below.

2. Coverage
This Warranty covers defects in workmanship only for a period of three (3) years from the date of project completion as noted on the original contract or invoice.
Covered issues include:
• Peeling, blistering, or flaking of paint caused by improper surface preparation or defective application performed by Horton Painting Experts.
• Paint failure due to a deviation from industry standards in our workmanship.
If qualifying defects occur within the warranty period, Horton Painting Experts will, at its discretion:
• Inspect the affected areas, and
• Perform touch-ups or repairs at no cost to the Customer, limited to the affected area(s) only.

3. Conditions Required for Warranty to Remain Valid
To keep this Warranty enforceable:
• The full contract price must be paid in full and on time per the agreement.
• You must retain a copy of the original signed contract as proof of scope and completion.
• All claims must be submitted in writing within the 3-year warranty period.
• The property must be made reasonably accessible for inspection and any repairs.

4. Exclusions – What Is Not Covered
This Warranty does not cover:
• Work not performed by Horton Painting Experts
• Repairs, modifications, or painting by third parties
• Projects using paint or materials not supplied by Horton Painting Experts
• Pre-existing damage or previous layers of failing paint
• Damage caused by:
• Vandalism, neglect, or misuse
• Chemical exposure, abrasive cleaning products
• Natural disasters (e.g., fire, flood, storm, or extreme weather)
• Structural issues (e.g., settling, shifting, wood movement)
• Surfaces inherently prone to paint failure, including:
• Galvanized or rusted metals
• Varnished, sealed, or high-gloss surfaces
• Areas of high moisture: decks, rails, stair treads, roofs, gutters, porches
• Color fading, UV-related changes, or exact color match
• Stains or bleeding from wood defects (e.g., knots or tannins)
• Cracks in drywall, stucco, plaster, or wood due to natural material movement

5. Limitations of Liability
• Our total liability under this Warranty is strictly limited to the cost of repairs for qualifying defects in the affected area(s).
• We are not liable for incidental or consequential damages, loss of use, or property damage not directly caused by our workmanship.
• This Warranty is non-transferable and applies only to the original Customer and property listed on the contract.

6. Claim Process
To file a claim:
1. Email us at info@hortonpaintingexperts.com with a description of the issue, date of completion, and photos if possible.
2. Provide your original signed contract or invoice.
3. All claims must be submitted within 3 years of the project’s completion date.
4. We will evaluate the claim and respond with next steps within a reasonable timeframe.

7. Governing Law
This Warranty is governed by the laws of the State of Texas. Any disputes arising from this Warranty shall be resolved exclusively in the courts of Fort Bend County, Texas.

8. No Other Warranties
No other express or implied warranties apply beyond what is stated in this document. This Warranty does not extend to merchantability or fitness for a particular purpose.

9. Subcontractor Disclaimer
Horton Painting Experts may, at its discretion, engage independent subcontractors to assist in delivering services. While we strive to work only with qualified professionals, any work performed by third-party subcontractors is done under their own licenses, insurance, and liability.
Accordingly, Horton Painting Experts shall not be liable for:
• Defects, damages, or delays caused by subcontractors not directly employed or supervised by us
• Work performed outside of Horton’s contractual scope
• Use of alternate materials or practices unless expressly approved by Horton Painting Experts in writing
This Warranty only applies to work directly performed by Horton Painting Experts’ employees or under our direct supervision. When subcontractors are involved, their scope and role will be disclosed in writing.
